Terms of Service

Last updated: September 2026

Acceptance of terms

By accessing thethirdwaycompany.com (the "Site") or engaging The Third Way Company ("we", "us") for services, you agree to these Terms of Service. If you do not agree, please do not use the Site or our services. Specific engagements are governed by individually signed agreements, which prevail over these terms where they conflict.

Our services

We provide software development, AI workflow automation, training, and assessment services. The scope, deliverables, timeline, and fees for each engagement are defined in a written proposal or agreement signed by both parties. These terms do not by themselves create an engagement.

Intellectual property

The Site content is owned by us or our licensors. For client engagements, ownership of deliverables — including source code, documentation, and configurations — transfers to the client upon full payment, unless agreed otherwise in writing. We retain ownership of our pre-existing tools, templates, and internal agent infrastructure, which we license to clients as needed for deliverables to operate.

Acceptable use

You may not use the Site to attempt unauthorized access, disrupt its operation, scrape it at abusive rates, or misrepresent your identity. We may restrict access for violations.

Professional advice

Content on the Site, including blog posts and case studies, is provided for general information and does not constitute legal, security, or financial advice. Assessment findings reflect the point in time at which they were produced.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages arising from use of the Site. Liability for services is limited to the fees paid for the engagement giving rise to the claim, as further defined in engagement agreements.

Changes

We may update these terms; the current version is always published on this page with its last-updated date. Material changes affecting active engagements will be communicated directly.
